IMAGINE THE PEUGEOT IN THE WORLDWIDE MEGALOPOLIS OF TOMORROW Create a Concept Car which is designed to evolve within the cities of the future, whilst retaining the key values of the 21st century. The projects should bear Peugeot's stylistic codes and must contain the following four aspects included in this design competition: environmental awareness, social harmony, interactive mobility and economic efficiency.
The general rules of the competition are as follows:
Entrants must design their project in accordance with the following theme:
“IMAGINE THE PEUGEOT IN THE WORLDWIDE MEGALOPOLIS OF TOMORROW”
Create a Concept Car which is designed to evolve within the cities of the future, whilst retaining the key values of the 21st century. The projects should bear Peugeot's stylistic codes and must contain the following four aspects included in this design competition: environmental awareness, social harmony, interactive mobility and economic efficiency.
Together with the design, entrants must include a text explaining the concept of the vehicle.
During selection, particular consideration will be given to the following: the originality of the concept and the clarity of explanations, faithfulness to the values of the Peugeot brand, creativity regarding style and the quality of the final product.
3.2. At the end of the competition, PEUGEOT will build a full size model of the winning vehicle, which will be exhibited at the Shanghai Motor Show in April 2009.
The eventual winner of the competition is hereby forewarned that he or she will receive no remuneration from this.
Article 4: Conditions of entry
4.1. This competition will be available on the Internet and can be accessed as follows:
- through the PEUGEOT Internet site URL “http://www.peugeot.com” under the heading “Design”;
- through a direct link from Peugeot Internet sites in participating countries
- through the virtual Second Life world via Peugeot Island “http://slurl.com/secondlife/peugeot/204/206/23/”
- through links from partner or community websites
4.2. To enter:
Any net users who wish to enter should connect to the Internet site “http://www.peugeot.com”, under the heading “Design”, between 20 April and 20 July 2008. Correspondence is by e-mail only. Follow the instructions on the website:
• the registration form displayed on the screen must be duly completed,
• the entrant's design(s) showing the PEUGEOT automobile vehicle must be included (1 to 5 image files, which must be in .jpg format, with a maximum size of 500 Kb per file),
• an explanation of the vehicle's design (in French, English or Spanish; in .txt format only, with a maximum size of 100 Kb).
• A video/animation showcasing his or her design (optional) in .FLV format, with a maximum size of between 1 and 10 MB and 400x300 dimensions.
The information requested on the form is essential for entry into the competition.
The Internet user must enter his or her registration form before 20 July 2008, 12:00 hrs GMT (Greenwich Mean Time), to which he or she must attach the design files, the explanation of the concept and, if necessary, the video/animation showcasing the design.
Any incomplete or incorrect registration or any registration which does not fulfil the required conditions will be considered as null and void.
One candidate may submit several designs along with the explanations for the concepts and, if necessary, the videos/animations showcasing said concepts.
For every new presentation of the design and explanation of the concept (and, if necessary, the video/animation showcasing the design), the candidate must, consequently, follow the aforementioned procedure to enter in this regard.
Article 5: Selection process and procedures
Stage 1:
PEUGEOT will select 30 designs from amongst the entries received.
The authors of these 30 selected designs will receive from PEUGEOT, a letter with an obligation of assignment of the copyright of their design, the explanation of the concept and, if necessary, the associated video/animation and, in the event that said video has been made by a third party, an obligation of a covenant for peaceful possession (in accordance with the provisions for assignment set out in article 8). This letter must be signed by the selected entrant and returned to PEUGEOT by express mail before the 10 August 2008, 12:00 hours GMT in order for the candidate's entry to be considered in accordance with stages 2 and 3. Said letter must be countersigned by the legal guardian of a minor candidate, otherwise the entry will be rendered null and void.
Any correspondence regarding the assignment of copyright which has not been received by PEUGEOT by the aforementioned date of 10 August 2008, 12:00 hours GMT, will automatically deny the entrant permission to enter the competition with this design. Consequently, said entrant may not lay claim to any rights to receive any prize or compensation whatsoever in this regard.
The definitively accepted designs, following receipt of the aforementioned letters, will be posted online on the PEUGEOT Internet site, as well as on dedicated competition sites in subsidiaries of the Peugeot brand, between 15 August and 15 September 2008.
Stage 2:
Internet users and members of the European automobile press selected by PEUGEOT will vote for a maximum of 10 out of the 30 initial designs. Following an analysis of the votes, the PEUGEOT judging panel, consisting of PEUGEOT members of staff who are experienced in the domain of automobile design, a representative from MICROSOFT and chaired by Jean Philippe Collin, Managing Director of Peugeot, will make a list of the 10 selected designs. The 10 designs selected by the PEUGEOT judging panel will be posted online between 16 September and 30 September 2008.
Stage 3:
The PEUGEOT judging panel will select the winner from amongst the 10 entrants whose designs were selected in stage 2 above. The second and third place competition winners will also be announced. The identity of the competition winner will be unveiled on PEUGEOT Internet sites from 2 October 2008 and during the “Mondial de l’Automobile” press conference.
Article 6: Provision
The competition prizes are as follows:
• the winner of the competition will receive the “La Griffe” trophy during the “Mondial de Paris 2008” and a prize consisting of the following:
- a cheque for €10,000 including tax (ten thousand euros including taxi
- entry to the Shanghai Motor Show 2009 (proposed date for said show: April 2009) for two days for two people including accommodation and full board worth €600 including tax (six hundred euros including tax). The return transport costs, in economy class, from the winner's home to the show will also be paid by PEUGEOT, the mode of transport being entirely at PEUGEOT's discretion.
- entry to the “Mondial de Paris 2008” (proposed period for said show: October 2008) for one day for one person including accommodation and full board worth €300 including tax (three hundred euros including tax). The return transport costs, in economy class, from the winner's home to the show will also be paid by PEUGEOT, the mode of transport being entirely at PEUGEOT's discretion.
- an Xbox 360 video games console worth €199 including tax (one hundred and ninety-nine euros including tax).
- the 1:43 scale model of the miniature (made by NOREV) of the Flux (concept car winner of the fourth Peugeot Design Competition, created by Mihai Paneitescu) worth € 35 including tax (thirty-five euros including tax).
Moreover, PEUGEOT already envisages that the winning project will be reproduced in the form of 1:43 scale miniature models which will be sold by one or more companies of their choice (see the section entitled “Derived products” in article 8).
• The second place winner will receive the following:
- a cheque for €2,500 including tax (two thousand five hundred euros including tax).
- an Xbox 360 video games console worth €199 including tax (one hundred and ninety-nine euros including tax).
- A 1:43 scale model of the miniature (made by NOREV) of the Flux (concept car winner of the fourth Peugeot Design Competition, created by Mihai Paneitescu) worth € 35 including tax (thirty-five euros including tax).
• The third place winner will receive:
- a cheque for €1,500 including tax (one thousand five hundred euros including tax).
- an Xbox 360 video games console worth €199 including tax (one hundred and ninety-nine euros including tax).
- A 1:43 scale model of the miniature (made by NOREV) of the Flux (concept car winner of the fourth Peugeot Design Competition, created by Mihai Paneitescu) worth € 35 including tax (thirty-five euros including tax).
• The remaining finalists in places 4 to 10 will receive:
- a cheque for €1,000 including tax (one thousand euros including tax).
- A 1:43 scale model of the miniature (made by NOREV) of the Flux (concept car winner of the fourth Peugeot Design Competition, created by Mihai Paneitescu) worth € 35 including tax (thirty-five euros including tax).
• Those entrants selected in places 11 to 30 will receive:
- a cheque for €300 including tax (three hundred euros including tax).
Regarding the prizes, these cannot be in any way contested by the winners, nor may they demand the issue of their exchange value in money, or their modification or replacement for any reason whatsoever.
The respective winners of the aforementioned prizes will be notified in writing of their win from 20 October 2008.
Any prizes awarded and not claimed by 31 December 2008 may not be claimed at a later date.
By entering the competition, participants recognise that the publicity that will be afforded to their creation due to its communication by PEUGEOT also forms an integral part of the compensation for the rights transferred to PEUGEOT below in article 8.
Article 7: Authorisation for communication
By entering, each winner freely authorises PEUGEOT, and/or any of their partners in this competition to use, for commercial and/or promotional ends, their surname, first name, address and image within the framework of any communication made in connection with this Design Competition and any past or future Design Competition.
Article 8: Usage by PEUGEOT of any elements submitted by the participants
• Guarantee:
Any person sending an illustration and the explanation of their design within the framework of this competition certifies and guarantees to PEUGEOT that they are the sole, exclusive author of it, and that it does not directly or indirectly infringe the rights of any third party.
As regards the video/animation of the design, the participant recognises:
- that they are the sole, exclusive author of it, and that it does not directly or indirectly infringe the rights of any third party
- or, if they are not the author, the participant guarantees to PEUGEOT that they have obtained all necessary authorisation from the author or authors of the video/animation for free use of the video described in these terms and conditions.
• Use of illustrations, explanations of the designs and, if necessary, videos/animations of the designs:
All entry into the competition infers the free and exclusive agreement from the author of an illustration (and from their legal guardian for an author who is legally a minor) so that their illustration, if it is selected at the end of the first stage by PEUGEOT:
- may be put online, on the websites " http://www.peugeot.com" and/or on the Peugeot websites for the participating countries, so that the judging panel for the second stage can decide which 10 illustrations are to be submitted to the judging panel for the 3rd stage,
- may be reproduced and depicted by PEUGEOT, or with the authorisation of PEUGEOT, in all countries of the world and for the duration of the author's rights, across all communication media relating to this Peugeot Design Competition and to past and future Peugeot Design Competitions, which includes the purchase of advertising space. This will therefore notably include: PEUGEOT press releases, PEUGEOT websites or PEUGEOT's partners' websites, the PEUGEOT museum, the PEUGEOT AVENUE websites, PEUGEOT in-house films, national and international exhibitions, all types of television broadcasts, brochures for automobile museums and exhibitions, etc.
- may be reproduced and depicted in all countries of the world, with the authorisation of PEUGEOT, by press and television news agencies, or via the Internet, for a period of five years from the publication by PEUGEOT of the 30 projects selected, across all of the media relating to this Peugeot Design Competition and to past and future Peugeot Design Competitions, notably with a view to promoting the next Peugeot Design Competition.
All entry into the competition infers the free and exclusive agreement from the author of an illustration (and from their legal guardian for an author who is legally a minor) so that the explanation of their design and, if necessary, videos/animations of said designs, may, at PEUGEOT's discretion, be used, reproduced and depicted under the aforementioned conditions and in the aforementioned ways.
PEUGEOT agrees to make no use of any illustrations which do not win, or of the explanations of the corresponding designs and, if necessary, the related videos/animations, outside of the situations provided for in this article. The authors of these illustrations, explanations of the corresponding designs and, if necessary, the related videos/animations, retain free usage of these if they so wish.
• Transfer of the rights of the selected authors at the end of the first stage and of the winner of the competition:
All entry into the competition entails the agreement to transfer to PEUGEOT CITROEN AUTOMOBILES (sister company of PEUGEOT, who is the holder of the rights to the design of PEUGEOT vehicles), for as long as the author's rights are valid and in all countries, the author's economic rights appertaining to their illustration, to the explanation of the corresponding designs and, if necessary, the related videos/animations which illustrate said design.
These rights include the economic rights to reproduce, depict and adapt, in any way, in any form, by any means and across any media whatsoever, at present or in the future.
This notably means that PEUGEOT CITROEN AUTOMOBILES is able to make any adaptation of the winning illustration, the explanation of the designs and, if necessary, the videos/animations which illustrate said design, which they deem necessary, especially for the construction of the full-scale model which will be based on said illustration for the Auto Shanghai Motor Show 2009.
In addition, PEUGEOT CITROEN AUTOMOBILES may use the illustration of the winning vehicle as an illustration and model in all countries, under their name and at their own costs, as they wish. The winner and, if the winner is a minor, their legal guardian, agree to complete and sign all documents which may be necessary for registration.
This transfer of author's rights is subject to French internal law.
The participants in the competition agree, by entering this competition, to confirm this transfer of author's rights to PEUGEOT CITROEN AUTOMOBILES in accordance with the specifications given in article 5 (stage 1).
We remind you that if an illustration selected, the explanation of the design, or, if necessary, the related videos/animations, has been made by person who is a minor according to the law of their country, those persons legally representing this minor must countersign the letter transferring the rights signed by the minor and any other document required for the participation of the minor in this competition.
Participants in the competition recognise that the prizes received by the winner, and the publicity from PEUGEOT that winning entails, are to be regarded as compensation for the transfer of their author's rights appertaining to their illustration, the explanation of the design and the related videos/animations and for the various permissions granted to PEUGEOT.
• Name of the winning vehicle:
The authors of the illustrations may suggest, if they wish, a name for the vehicle project that they have sent to PEUGEOT for the competition when confirming their participation as specified in article 4.2 above. However, all participation in this competition infers the prior agreement of the winner of the competition that PEUGEOT is able to change the name of the vehicle at any point, for any reason, notably if the copyright for the name is not available.
If a selected illustration does not have a name, PEUGEOT will be free to provide it with a name of their choice.
In any case, by entering the competition, the future winner agrees to transfer the rights to the provisional name they have suggested for their vehicle, if this name were to be eventually retained by PEUGEOT. The winner (and their legal guardian, if the winner is a minor) agrees to confirm this agreement to transfer upon receiving a letter from PEUGEOT relating to this issue.
Equally, it is agreed that the final name for the winning vehicle will be able to be used as a trademark by PEUGEOT, under their name, at their own costs and in all the countries they choose.
• Derived products:
PEUGEOT already envisages that the winning vehicle will be reproduced in the form of 1:43 scale models, which will be mass produced and sold by one or more companies of their choice. It is possible that PEUGEOT may also wish to manufacture other scale models of the winning models of a different size.
By entering in the competition, the future winner (and their legal guardian, if the winner is a minor) has already given authorisation to PEUGEOT to authorise manufacturers of scale models to reproduce their vehicle.
The name of the winner will, of course, be stated on the packaging for the miniatures as the creator of the vehicle design.
The winner will be regularly informed of the progress of the manufacturing process.
Several miniatures may be given free of charge to the winner, and the latter will receive, on an annual basis, as payment for the manufacture of the miniatures, an amount before tax equivalent to 1% of the profit before tax made by the manufacturer for all of the sales of the miniatures in a year at the end of that year.
Article 9: Reimbursement of costs
Participation in this competition is free. The costs of telephone communication (Internet connection to the competition site) incurred for participating in the competition will be reimbursed by bank transfer upon receipt of a written request (reimbursement of the stamp at the current standard rate upon request), accompanied by bank account details, addressed to:
